BMW has optional Altezza style lights for the new 5er ?
I am a member of the BMW Press Club and was searching through their site of press photos, and came across this one under the optional accessories category.
Are BMW selling Altezza style lights as optional parts?
Can anyone here that works at BMW shed some light on this?

They are not Altezza, they are all clear. BMW has had that style light as an accessory on many models at least since the E39's conception, maybe even further back.

It would be legal, I think, as long as the bulbs are coloured correctly.
And yes, I have seen the e46 Ti's

Yep.
And they are legal, since the bumper has it's own reflector (the reason all clear tails are illegal on Civics and such is because the reflectors are integrated into the lamp assembly, and therefore lost with all clear lenses).
