Interestingly enough in the class action lawsuit launched in the US, during the settlement BMW agreed to fix the problem provided that owners did not mount wheels over the manufacturer recommended 18 inches. The court agreed. So, if you were dumb enough to show up at a dealer with 19 inch wheels to get $5000 in free welding done at BMW's expensive, you were informed you failed to follow the recommendation and the work would not be covered under the settlement.

Those original welds were terrible! No surprise it failed again. The new setup however looks fantastic!

Maybe post 2003 owners are not part of the class. More or less, the fate of 1000s of owners rested on a single judge listening to both sides of the argument. If the plantiff's lawyers failed to point this out, or there was not enough evidence to support the case, I could see how the 18-inch wheel restriction could be squeezed in. Unfortunately if you had a crack, and 19-inch wheels and they were from the factory, you'd be left out. It's pretty evil not to fix all the cars that had cracks but then again, it's not like BMW failed to put a metal shield in front of the gas tank to protect rear seat occupants from being immolated in a rear end collision all for the sake of saving a few bucks. You have to buy an old GM to get to that level of evil.
