Pre-owned cars and spare tires

I got a flat on the 404 on the way home from work on Thursday night. I pulled over, jacked up the car and removed the flat in a rain lightning directly overhead. I pop the spare out of the trunk and the damn thing doesn't fit. The tire is the correct size but the rim has the audi/vw logo on it. So I got the car towed and repaired the flat. I'm amazingly livid that the dealer sold me a car with a spare that does not fit. Can I go back and demand a correct spare? I bought the car in December.

Its a easy item to never check it untill you need it (too late at that time), so if you bought/owned the car without knowing for so long, the dealer will say the same thing; "we didnt know". Even when a safety is done, most just look to see if you have one, not if its the right one!

If the dealer doesnt give you one, i should have the right one for sale.

^The car will have technically failed safety without a proper spare, i'm sure if you make a big enough stink about it they'll give you one. Having said that, i dont think fil would charge you that much for a spare, might not be worth the hassle.

If they don't offer you the proper spare at their expense, you can threaten to goto Omvic and complain they sold you a car with improper spare, and you don't know how they passed the cars safety with the improper spare. You can also complain to the MTO about this dealer selling you a car safety and certified with an improper spare but that might cause you more problems than good.

Although technically, any dealer can throw any "spare" tire in the trunk and get the safety done... Most people writing the safetys easily will "overlook" this.

I'm most curious which dealer you bought it from! and I'll tell you how hard you'll have to fight for the proper spare!
