Judge rules company failed to warn family of risks of installing slide on 4-foot-deep backyard pool





A Hamilton woman who became quadriplegic at 15 after sliding into her family's backyard pool in a crouched position was awarded $4 million in damages from the parts supplier for the slide.

A provincial appeal court ruled that the Hamilton company, Pioneer Pools, should have warned the Walford family to go down the slide feet first only – a precaution that would have prevented Correena Walford's accident in 1996.

Sales staff told Marion Walford, Correena's mother, it would be "okay" to install the slide on their 4-foot-deep above-ground pool. The company did not sell them the slide – the family bought it used – but provided replacement parts for it.

"But for the failure of the respondent's employees to respond to Mrs. Walford's inquiries by warning her of the risks of installing the pool slide on her 4-foot pool, she would not have erected the slide and Correena would never have been injured going down it," Justice Kathryn N. Feldman wrote in the decision.

The court found Pioneer Pools liable for 80 per cent of the damages, assessed at $5 million in trial court. It ruled 2-1 yesterday to overturn the trial court's 2005 dismissal of the suit.

Correena Walford was held responsible for 20 per cent of the damages because she ignored her mother's warnings to go down the slide "on her bum."

Paul J. Pape, one of the attorneys representing the Walfords, said Correena didn't know it was dangerous to slide crouched over her knees.

"She'd been on many slides before in public facilities where depth is not an issue," Pape said.

Pape said he expects the suit will go before the Supreme Court.

The manufacturers of the slide and pool and the people who sold the slide to the Walfords were found not liable in trial court. They were not mentioned in the appeal.

**** if I made and sold ANYTHING, I would force my cashiers to get the person on video saying "I accept the risk that I may be too stupid to be near this product and anything that happens as a result of me having it is my responsibility"

EDIT: I think the slide company should now sue the pool company for 4 million because they didn't warn them that they should warn people about cheap stupid bastards that could buy their slide and use it with their toilet.

They should sue the parents for not diciplining the kid good enough!
lol this is so wrong its a joke! I mean i am sorry bout the girl but it was her fault really. This is like me jamping my car over the Grand Canyon and failling. Then sue BMW for not having a warning about cars not being able to fly!

God, I hope they do. They shouldn't have to be responsible for someone elses stupidity.

What ever happened to common sense? "Don't go head first down a slide into a 4 foot shallow pool."

I don't need a warning label to tell me that sounds dangerous.

The worst part? The mother TOLD her kid not to do it, and she did it anyways. That bitch should have listened. Now she has to eat mashed potatoes for the rest of her life.

Does anyone know if they do anything to the judges who are determined to have ****ed up so badly? I mean with one hit of the wooden mallet they can ruin lives - it's only fair that they get theirs ruined if they didn't do their job properly.

how tall was this slide? how do you cripple yourself in a 4 ft pool going down on your knees, sounds weird to me.

not likely .. most pool accessory companies have gone down under as they dont make the sales. All the companies in canada have gone under but this could be because of these products being less seasonal here.
