Can he be Sued?

My dad was in a slight fender bender over a year ago....

Some guy going through a light clipped my dad who was waiting to make a left hand turn. My dad was charged. There was hardly any damage to the cars. my dad just needed a new turn signal and a crack on the bumper. The other car was pretty much the same.

This guy never said about any injuries or anything at the time....

Now over a year later, I just get a call from the insurance company that the guy that my dad was in an accident with got himself a lawyer and is suing for pain and injuries??????

WTF??????

Does this guy have a case?

instead of asking maXForums, contact a real lawyer...

asking legal advice on maxbimmer is like asking revshot for moral advice..

I seriously am starting to think that its better to be a criminal in this country.....

In North America, the Criminals are protected while the innocent are the prey.

You may have a sex maniac living next to your house, your kids may be in danger, and the government is not allowed to release the name of the offender because its against the law???/

WTF????

And then when something happens to your kid becuase of this guy, its too late.....prfttt, BULL SHHIIIT

Today, I finally got my mom to admit that I am right when I say that Criminals are protected in North America.

Someone goes and kills someone, and then goes to court, then pleads insanity, and gets left off the hook,,, while the killed persons family suffers. Pisses me off.

My dads case is just a small example of this.

Why was your dad charged? If he was charged, he was the one at fault in the cops eyes

A friend of mine is going through the same thing... except his 'incident' happened 2 years ago... he called the insurance company to see if the guy sueing him had a case... the insurance company laughed and said 'they'll take care of it'.

Yes, my dad was charged for careless driving by a young police officer. We went to x-copper and explained to them what happened and they laughed at it and said those young cops don't know anything.....

Went to court, paid like some minimum ticket no careless, no points no nothing.

I just spoke with a family friend that told me the exact same thing that you are telling me.

Except she added this; The law firm that is representing the other guy is not allowed by law to send a letter to my house but rather only to the insurance company.

Because of this letter, my mom is now upstairs laying on the couch in pain and in stress. My mom is an ill patient that has the Fybromalagia virus and suffers under depression.

This isn't right....
Just not right....

Now what if the guy is reacting to the accident like your mom is to his lawsuit?

You really should contact a lawyer and if you believe he is filing a frivolous lawsuit, you should counter-sue. Document your mother's condition and call a lawyer.

Same happened to us... My mom read ended some driver instructor cuz he stopped to let the police cuiser that suddenly turned on his lights n'way Police was there my mom charged we let the insurance company know and the guy was all happy and walking around... Year later we get a nice letter from this guy that my mom rear ended suing us for 1.5 million dollars for spinal injury brain damage and that the person will be suffering with headaches for rest of his life... the funny thing is if those kind of injuries would accure then I'm sure atleast a neck brace will be required and ambulance would of had to be on the scene which there wasn't any... at the end insurance company took over the lawsuit and I don't think the guy got anything from us or the company ... and I think due to the new laws in order for you to claim the insurance money for a settlment you have to go see a doctor for a year because then you know it must be serious accident and thats why he wated so long....
