UPDATE : So it's been a while BUT! we replaced the part the Mark suggested and sure enough the car now shifts into gear as it should with no problems ! now all we have to do is the head gasket, already taken the head out and it will be getting an extremely thorough cleaning !

Thanks, I will have a new thread on what My E36 as well as my brother's E36 look like and have (upgrades) once they are worthy enough to show up at a MaX meet!
