Angry Class Action Suit for N54/Turbo Owners - RESPOND

Hi fellow N54 Owners,

As you know, last year in the United States, BMW extended their warranty to cover the turbos/wastegates for certain models of the vehicles that use the N54/Twin Turbo setup. A class action suit was started in California and BMW responded by extending the warranty for the turbos for up to 8 years / 82,000 miles.

As a frustrated Canadian, we are always being left out. If you are like many who have failed turbos or extremely noisy waste gates, and if you would like to participate in class action suit, please let me know by responding to this thread.

INFORMATION

All issues relating to the last-minute appeal have been resolved and the new effective date of the settlement is July 11, 2012. The court-approved settlement provides the following relief to the Settlement Class Members’ vehicles listed above.

SITUATION

BMW NA has agreed to extend, to a total of 8 years or 82,000 miles, whichever comes first, the emissions warranties covering the Settlement Class Members’ vehicles for any failure of a turbocharger caused by a defect in a turbocharger wastegate. The terms of the original New Vehicle/SAV Limited Warranty and applicable emissions warranty still apply. BMW NA will not provide warranty coverage to any Settlement Class Member’s vehicle containing modifications or alterations to the turbocharger or its wastegates (software, hardware or otherwise), or evidencing other conditions not normally covered under the original New Vehicle/SAV Limited Warranty or applicable emissions warranty.

Modifications excluded from warranty coverage include any aftermarket parts that affect the turbocharger system, or if there are other conditions that would normally exclude it from warranty coverage.

WARRANTY INFORMATION

The emissions warranty for the turbocharger wastegates has been extended to 8 years or 82,000 miles, whichever one occurs first, for a failure of a turbocharger caused by a defect in a turbocharger wastegate that does not otherwise fall within exclusion to coverage under the warranty. Any applicable TeileClearing or Diagcode requirements still apply.

The turbocharger wastegates’ 8 year/82,000 miles warranty supersedes any applicable coverage provided under the BMW Certified Pre-Owned program or any BMW Group Vehicle Service Contract in effect. This component’s warranty extension applies to the above-listed models only. It is applicable to eligible vehicles which are registered and operated in all 50 states. The existing warranty coverage for all other parts has not changed.

BMW is informing all eligible Settlement Class Members of their extended turbocharger wastegates warranty.

I have a 135I and this is the first I'm hearing of the N54 having any issues.

How common is this issue???

OP, Why is there frustration the extended warranty is for all BMW North America.....

Pretty common with 07-08 N54s along with HPFP which also has an extended warrenty

75,000+ kms on my N54 and no issues

This thread is for N54/Turbo Engines. E90, E92, E93. The warranty extension does not apply to Canada. The purpose of this class action is to get BMW Canada to do something about it.

Please read about it via searches. Very common problem with the N54.

i have a non recalled 01 S54 (stock bearings) that i drive hard and put away wet constantly. it has been a model of reliability

Ur right, stupid BMWNA is some how only US...wtf. The warranty really should be extended to everyone not just the US.

Just talked to my dealer they are aware of the wastegate issue and that BMW Canada has not extended the warranty but they have replaced the turbos on multiple cars on a case by case basis successfully covered. As well they mentioned CPO cars have the turbos covered till 160,000 kms.

Please respond if you would like to be part of the class action suit. You must qualify by being affected with the problem (previous turbo replacement, waste gate rattle or noise, low/high pressure fault codes, or a decrease in performance). You must also own a model (eXX series listed above) that this warranty covers.

Please less chatter about other models and other engines. This thread is just for the N54.

ADD: Even if you do not experience the problem, one day you might. Especially if your vehicle is lower mileage. The warranty extension would take the existing warranty 4 years 80,000kms and extend it to 8 years 82,000 miles (about 132,000km or so we hope).

Wastegates have been rattling since 38000KM. Absolutely annoyed at BMW for extending the warranty only in the US. It's the exact same crappy turbos that have the exact same crappy issues, just like the crappy break squealing
