Ebay deal gone wrong...

Seems pretty clear that it was a screw up - but if you were the guy who bought the Bentley what would your position be?

I'd want the bentley for 14K. The dealer would tell me to **** off. That would be / is the position.

That guy knew its too good to be true once he won the bid..
and expected the dealer to counter offer . even wanted to buy that Bentley at cost... seems reasonable to me...dealer's mistake and Ebay sided with dealer ....he has the mean to sue if he wants to...

1) auto bids on ebay are not legally binding
2) the buyer admitted he knew that was not the intended selling price of the car
3) the buyer expected to be able to profit from the dealers mistake. There's no reason for them to allow a customer to do this.

Dealer is in the right, 100%, if i owned a dealership i would've said no too. He didn't "BUY" the bentley. He didn't sign anything or recieve anything signed that he owned it or was buying it.

He knew there was an error when he was bidding so he has no case,, he even admitted it. Mistakes don't count as legally binding contracts.

Even under contract law, if you were to make a contract with someone else and make such a mistake the contract could be cancelled under mistake because both buyer and seller know what a reasonable price is for such a vehicle.

Now if in real life/person to person transcation had been written up in contract and the seller wrote 104,000 instead of 140,000 that kind of mistake might not be ammended.
