Question Got rear-ended, got a question



Hello,

I got rear-ended yesterday evening. Fortunately we are all ok, and this is the first time I've been hit so I would like to get the opinion of some members who have experience dealing with damaged cars and insurance.

I've attached one picture of the damage below, hopefully I will get more soon. The car is only 5 months old, do you think they will attempt to repair it or write it off? I would prefer to have it replaced completely. The insurance guy is supposedly going to take a look at it tomorrow. If they do decide to just repair, how would I go about to try and request a replacement instead. The accident was 100% at fault of the guy who rear-ended me.

probably write off by the looks of it... that car doesn't cost much in the first place

It all comes down to your insurance company! There is no real rule about it, even if it comes to $10 less to fix (then replace), they can do that. OR they can write it off for $5000 of damage...

yea, really depends if anything structural under the bumper was damaged,

did the air bags go off?

it almost looks like the quarter panel and rear bumper are one peice?

Thanks. No air bags went off because I didn't slam the brakes. The rear bumper is separate from the panels:

tought to say. at first glance. id say write off...
but the harder I look... could just be a trunk/rear bumper.

it depends whats going on underneath/further down the car.

is that an old ontario plate(or quebec plate)?

Wow, glad everyone is alright.

You can tell your adjuster that if it's on the line, "i'd prefer to replace" but as previously mentioned, It is the insurance companies right to decide if the car is repaired or replaced.

I have just a few questions so I can try and point you in the right direction...

Look over your insurance policy. Do you have OPCF 43 "limited waiver of depreciation" on this car?
Is this car leased, financed, or owned free of liens?
Did you buy it brand new or was it a demo/used?

The car is registered in QC, my sister was visiting for the weekend but I was driving it. Its owned, brand new. I'll look into the OPCF 43.

It won't be called OPCF (ontario policy change form). I'm not sure what they call it in QC. Look for "waiver of depreciation" en francais

If you do have that coverage, if the car was a write off, you'll get a brand new one (as opposed to a few month old used car, or monetary settlement relative to that).

I'm very glad nobody was hurt, injury coverage on QC policies is nothing compared to ON. However, if you did sustain any late developing injuries, you will make the claim under your own Ontario auto policy.
