Questions about traffic court



i have traffic court tmrw,

i got pulled over with my jeep plates on my old e36 (aug 2009) and no insurance slips ( i did have insurance tho) and vehicle wasnt registered in my name. i recieved 3 summons to court. 2 days before my court date (september 2009) the officer showed up at my door and gave me 3 new summons because there was a **** up in the court office. my new court date was for (november 2009) i missed that court date i called the court and they said it was re scheduled for (march 12th 2010) i havent received any documentation for this new date.

when the officer came to my house i asked if he called my insurance company he said yes and that he verified i was insured. so my question is what are the possible rulings against me? how early before my scheduled court time must i be present. anything else i should know as i have never been to traffic court before.

Things comes in three and it looks like you're the winner of this one. First matter is that you have plates for the wrong vehicle. Second you didn't product a valid insurance slip for the vehicle when asked. If you didn't have the ownership that would be strike three. Don't think the rescheduled date will play any favours since the new summons was delivered to you. All you can hope for is that they drop or reduce the fines.

ok.. since its a summons will it get dropped if the officer isn't there?

Generally yea because there will be nobody for you to go against.

But how in the hell did you get a court date so early? My court date for my careless driving ticket was a good 8 months after getting the ticket. Dropped because the officer wasn't there BTW.

ok and the officer never came to my house after i missed the court date nor did i get any phonecalls or letters since he didnt come to my house im going to assume he didnt show up that date either. he was more then fair when he pulled me over. he told me to get my ass home and take the plates off the car. he knows i have insurance cause he called. so i really doubt he will show. my origional court date was 1 month after i got pulled over.

Well driving with invalid plates is a big nono, so doubt you'll get away from that one; you'll probably get the fine itself reduced but still subjected to demerit points (issuing officer has the authority to seize your plates/permit for this offence).

The fail to "surrender insurance card" will most likely be dropped if you can prove you have insurance at the time of the conviction.

In terms of the time, generally I'd advise people to be there 20-30 early because the line-up is usually long every single day.

Misc.:
-dress in presentable attire
-be polite
-know your rights in a trial

thats what i thought ivan but nope. if convicted you can be sentenced to serve jail time. such a bullshit ****ing law.

i consulted ott legal while i was waiting for my trial the guy was very helpfull and gave me really good advice. made me feel allot less nervous!
