If the head hasnt been changed yet, you'll get the dreaded "ticking" noise which without warranty costs about $8000-9000 to replace with new factory parts at dealer rates.
Personally i would spend the extra and get a certified series.

I heard a minor tick reminded me of my e30. Unfortunatly I don't think I'm persuing this car I went to drop off a deposit lastnight after I did that I signed an power of attorney for some reason, then I was told they are going to keep the ownership for my jeep the vehicle I'm still driving.. I would be given a photocopy......ummm no. Then I was sent to speak with the finance dept and they wanted me to sign a purchase agreement... I refused and the guy started being a dick so I'm walking away. My deposit is refundable but they don't know when they can give it back to me because they don't have the code to open the safe....

i don't get the deposit thing. so you gave the deposit and signed something? what did you sign? the dealer doesn't have to give the deposit back. that's the point of a deposit that you are intending to buy it.

I think he did the reverse;
give deposit first then send to rmp or bimmersport for inspection..
the dealer should allow you (Eurocar demands that you see your own mechanic first) or you demand that an inspection by your mechanic be the 1st business then you take it from there..
he will get back his deposit after they minus administration fee...

I guess whats important is that you're confident in the sale.
How much is it? km?

06/07 323i sell for 14500+ at BMW Financial auctions with the remainder of the factory warranty - the cheapest off-lease BMWs ever.

"$18,900, 80,000 roughly dark silver sedan. Nothing compares"
You should at least look at a CPO vehicle. For a '07 CPO'd 323i you may be able to get around 23-24K...especially since it's now 2011. I know we are talking about an extra few thousand bucks, but you will have warrenty until 160,000kms. I'd assume warrenty on what you are buying is done (80,000km). Also you should get 1.9% financing (60mths). I'd assume the car you are looking at is at regular bank finance rates.
Sit down with a CPO rep and see what your monthlies will be for CPO vehicle. I have never regretted my decision to go CPO. My friends and family are all "wow a BMW, must be nice..." I'm paying less for my CPO bimmer then they are for their Ford Escapes and Dodge Caravans...
