do the clear tails fit a vert?

Vert tails are specific to verts, trust me, I converted my yellow to clear and it was a long search. The other option is to buy aftermarket LED's ($315 @ Bimmian) or buy the OEM package at the dealership (~$600 + $120 for 3rd brakelight).

Would a M3 vert taillights fit a non-M3 (325ic)?

Funny you ask. I was at the mechanics today and he asked me why I didn't go with the 330 Vert LEDs. He talked about a harness and flashing the computer. I'm not sure if I can answer your question with certainty. Go with the aftermarkets that have been adjusted to accommodate our vehicles. You should post the question on the E46 section and see if anyone would know for sure.
