so some asshole ran a red light today... we had 4 guys in my car... hit him about 80km/h no injuries on any of us

hit a ford edge....

the guy told the cop his light was green and there were no witnesses..
any suggestions what I should do?

as far as next? 100% another BMW.... i have new found appreciation for well built safe cars

After looking at the pics again, what exactly happened? to me it looks like you were making a left and then he hit you? or were you going straight and he hit you?

Even there is no witness and based on information provided by you and the driver of the Edge, the cop can determine (based of the damage of both cars), who is at fault.

From the pix..looks like axle is broken, alot of damage, be good if insurance write it off;
I am no insurance adjuster, probably looking at more than 10 grand (parts and labour)

Send to a bodyshop that knows BMW and get original parts if it is not written off, also check your electronic. I.E check door actuator make sure it works, FOB can open all doors and sunroof - know this because a friend of mine was involved in accident last April (truck rearended him) and found out later those were working intermittently.

car can be replaced.. glad that 4 of you are ok....

We were driving straight and he wanted to go across the road that we were on. He pulled out and I kept thinking he was gonna realize what he was doing and stop. Soon enough I had to start swerving to the left but hit middle/pass side directly into his driver front corner. After the initial hit the back of the car swung around and hit his rear quarter panel and launched him farther down the road. I am also wondering what the other bags were thinking????? And yea there will be LOTS of parts people will be able to use.

That doesnt make sense .. so the cop just takes the other guys word for it? so you ran the red instead of him? where is his proof?

If you were going straight (and green), and he was turning, then he's at fault.

The only thing that could be an issue if you're found to be running a red, even though you were not by false testimony.

Get on the Trader and start getting screenshots/print outs of cars of similar condition/km/year/options to validate actual value. You’ll need this if the insurance tries to screw you on replacement value. BMW/Luxury cars have dropped big time in value.

If the insurance write it off.. you wil get the cash, else they wil repair it.

was yr car towed to a bodyshop? if its there.. an adjuster wil come and look at it.. just hope he will write it off....

You can try and sue his insurance company for injuries, but any legal actions will not get you money for years to come. Coutrs are overbooked 2-3 years in advance.

I don't know if there is much you can do here.... your insurance company has every right not to cover you if you didn't pay them. They will work day and night to find a loophole and grab onto it. Looks like they found yours.

Good luck sorting it out... but man, I'm glad I'm not in your shoes.

That sucks about the insurance. I thought there was a grace period on this type of thing but it seems not.

Insurance payments (House, Car, Health, Life) should just be on Pre-Authorized payment, just like mortgage and car payments then they don't get missed.

If your late on other stuff (Rogers, hydro whatever) they'll just ding ya for interest next month but they won't cut you off (right away).

i really do hope your insurance covers that.

WRONG! don't lose hope man, thats what these insurance companies want.

listen to my story. my brother's gf missed 4 months of payments, then she had an accident and they covered her! she just had to pay a $600 fine but insurance did cover her. This didn't come easy though I think she talked to a lawyer. you def want to be covered by insurance because other than the cost of the car you might even be held liable for the other party's "injuries" couple of months from now. don't let them screw you.

^Correct. Remember the agent that you recommanded me to, they do renewal every six months. Even if you miss all payments, they will cover you. You agree to that deal and they have to cover you. It is up to them to collect the funds. That's why we have collection agencies and others that chase you for the money.

btw, when you're up for renewal, ask her about the new package they offer. I got a sweat deal at $120/mth for car, life and renter's insurance combined and I'm only 22! I got 25% off for my marks though so if you're at uni with good marks that helps too.

Okay. Yup those guys are very fair. Now in February, they are doing some review. If you had a clean driving sheet, they will be quite reasonable. They quoted me 180ish for 2005 ZHP 330ci, and just over $200 a month for the E46 M3. I am planning on longhaul with them. Can not beat those rates. I need to take you for a dinner at 1001 nights lol for doing me a favour lol. Me and my Persian buddy always go there. Steeles and yonge.

I have to disagree. Over 12 years ago I missed a payment, without my knowledge the insurance cancelled my policy. My car was driven without insurance for 6 months. One day I placed a call to change my policy when I was given the good news. It is not the insurance company’s responsibility that they receive the payment on time. It is also not their responsibility that you get a cancellation notice of your policy in your mailbox. Some companies do have in their policy that there is a certain time frame that they will cover you if your policy expires. Hopefully this is the case here.
Having said that; the biggest crooks out there are the insurance industry period. They will do anything they can to try to get out of a claim.

I paid them for the first 6 months and then again for the last 6 months. The last 6 months with a money order.

hey good thing everyone was ok

i was in a similar accident about 4 months ago except i hit the guy who cut me off in the back driver side with my front left side and i hit at about half the speed that you did. my car was a rite off *thmbsdwn* but now im driving a bmw *th-up*

you should use your passangers as your witnesses but the damage on the cars tells the story no matter what the other driver says and then it turns into an insurance war so good luck and hope to see you in an m3 soon *wave*

Ps. il pay you $50 to $100 bucks more on the highest offer you get for all interior cabin and trunk parts:trim, seats( if automatic + heated,), visors, lights... i just bought a 02 330ci with tan interior and i want black so when your ready and have somewhat sorted threw the mess send me a pm *uzi*

I don't think your insurance company can drop you for missing ONE payment unless they provide you with written notice of your coverage being dropped. Contact a lawyer.
